RETURN POLICY

At Web App Marketing Sdn Bhd (1600388-U) (“we,” “us,” or “our”), we are dedicated to delivering high-quality digital solutions that meet your expectations. We strive to ensure client satisfaction, but we recognize that circumstances may arise where a refund or return is requested. This Refund and Return Policy outlines our processes to ensure transparency, fairness, and compliance with applicable laws, including the Personal Data Protection Act 2010 (PDPA) of Malaysia.

1. Eligibility for Refunds

Refunds are available under the following conditions, subject to review and approval by Web App Marketing Sdn Bhd (1600388-U):

  • Deposit Refund: Clients are eligible for a full refund of their deposit within 7 days of payment, provided no significant project work (e.g., planning, design drafts, coding, or campaign setup) has commenced and no ideas or concepts have been presented.
  • Post-Demonstration Refund: If initial ideas, concepts, or drafts have been presented, clients may request a partial refund within 7 days of payment if dissatisfied with the project direction. The refund amount will be calculated by deducting costs for work completed, based on hours spent and resources utilized (e.g., labor, third-party services), with a minimum deduction of 20% of the deposit to cover administrative and preliminary work.
  • Customized Services: For bespoke services (e.g., tailored marketing campaigns or custom-coded websites), partial refunds will be assessed based on the percentage of work completed, as outlined in the project’s Service Agreement.
2. Return of Work

In the event of a refund request:

  • All intellectual property, concepts, designs, code, or materials created or demonstrated by Web App Marketing Sdn Bhd (1600388-U) up to the point of refund remain our exclusive property.
  • Clients are prohibited from using, modifying, reproducing, or distributing any materials, designs, or ideas presented during the project, whether in whole or in part, without prior written consent.
  • Upon refund approval, clients must cease using any deliverables and return or destroy any copies of materials provided, as confirmed in writing to hello@manyproject.my.
3. Conditions for Refunds

To be eligible for a refund, the following conditions must be met:

  • The refund request must be submitted within 7 days of the initial deposit payment.
  • No substantial deliverables (e.g., completed websites, applications, or final design handoffs) should have been provided. For post-demonstration refunds, the project must not have progressed to an advanced stage, as determined by the milestones in the Service Agreement.
  • Refund requests must be submitted in writing via email to hello@manyproject.my, including:
    • Client name and project details.
    • A clear explanation of the reason for the refund request.
    • Any supporting documentation (e.g., project correspondence or feedback).
  • Requests will be reviewed within 5 business days, and clients will be notified of the outcome, including the refund amount (if applicable).
4. Non-Refundable Cases

Refunds will not be provided in the following situations:

  • After the final project deliverables have been delivered and approved by the client, either explicitly (e.g., written approval) or implicitly (e.g., use of deliverables in live environments).
  • For additional services outside the original project scope, including but not limited to rush work, extra revisions beyond the agreed number, or third-party purchases (e.g., domain names, hosting services, plugins, stock images, or advertising credits).
  • If the client fails to provide necessary feedback, materials, or approvals within the timelines specified in the Service Agreement, resulting in project delays or cancellation.
  • For consultation, planning, or strategy sessions already conducted, as these are considered completed services.
  • If the client uses or distributes any project materials without full payment or authorization.
5. Refund Processing

Upon approval of a refund request:

  • Refunds will be processed within 14 business days from the date of approval.
  • Refunds will be issued to the original payment method used for the deposit or progress payment, unless otherwise agreed.
  • Clients will receive a confirmation email detailing the refund amount and processing timeline.
  • Any applicable taxes (e.g., SST) included in the original payment will be refunded in accordance with Malaysian tax regulations.
6. Dispute Resolution

If a client disagrees with a refund decision or believes the refund amount is incorrect:

  • The client may submit a written appeal to hello@manyproject.my within 5 business days of the refund decision, providing additional details or evidence.
  • We will review the appeal and respond within 7 business days, with a final decision or proposal for resolution.
  • If the dispute remains unresolved, it may be escalated to arbitration in Kuala Lumpur, Malaysia, under the rules of the Asian International Arbitration Centre (AIAC), as outlined in our Terms & Conditions.
7. Project Cancellations

If a client cancels a project after the 7-day refund eligibility period or after significant work has begun:

  • The client will be responsible for compensating Web App Marketing Sdn Bhd (1600388-U) for all work completed up to the cancellation date, including labor, resources, and third-party costs.
  • An invoice for completed work and any additional services (e.g., out-of-scope revisions or expedited tasks) will be issued, payable within 7 days.
  • Deposits and progress payments are non-refundable, as outlined in Section 1.
  • Cancellation requests must be submitted in writing to hello@manyproject.my, specifying the project and reasons for cancellation.
8. Client Responsibilities

To facilitate a smooth refund or cancellation process, clients agree to:

  • Provide timely and accurate information when requesting a refund or cancellation.
  • Cease using any project materials upon cancellation or refund approval.
  • Cooperate with Web App Marketing Sdn Bhd (1600388-U) to verify work completed and calculate any applicable refund amounts.
  • Adhere to the timelines and conditions outlined in this policy and the Service Agreement.

Failure to meet these responsibilities may result in delays or denial of refund requests.

9. Changes to This Policy

Web App Marketing Sdn Bhd (1600388-U) reserves the right to modify this Refund and Return Policy at any time. Changes will be effective immediately upon posting to our website (https://manyproject.my). Clients will be notified of significant changes via email or a website notice. Continued engagement with our services after changes are posted constitutes acceptance of the revised policy.
